MEMORANDUM
OF UNDERSTANDING

1. All
existing language regarding the terms and conditions of employment for UTLA
members of the Division of Adult and Career Education set forth in the 2001‑03
agreement shall remain the same except as modified by this Memorandum of
Understanding. Except as otherwise
specified below or herein, this Memorandum of Understanding concludes
negotiations between the parties with respect to the 2001‑2002, 2002‑2003
school years.
2. The parties
shall add a provision to the Agreement that reduces Step Advancement/
Longevity hours to 734 hours per school year, including hours paid as an adult
education substitute. The above
referenced 734 hours excludes all hours worked during summer school. (Article XXI,
Section 4.7b2 and Article XIV, Section 16.0b).
3. The
parties shall add a provision to the Agreement that pertains to Step
Advancement for those teachers working less than 18 hours a week to read as
follows: Those teachers assigned less than 18 hours per week may complete the
requirements in one school year or use the two (2) consecutive school year
option. Under the two‑school year
option, the candidate for advancement in Year One must declare in Year One
which two (2) consecutive school years are being used by April 15. (The
candidate may not carry over hours from Year One if advancement is not
accomplished in the declared two (2) consecutive school years.) The candidate must accrue 734 hours including
hours paid as an adult education substitute and complete 30 hours of staff
development, in two years. (Article XIV, Section 16.0 b)
4. A Staff
Development Plan is accepted by both parties and will require all documents for
Step Advancement to be submitted in one packet to Adult Personnel by June 15. If Step Advancement packets are received
after the deadline, these materials will be returned to the sender for
submission in the following school year.
Reference to the plan in Article XIV, 16.0 b reads as follows: Effective
July 1, 2002, the employee must have been paid on the adult hourly rate
schedule for 734 hours including hours paid as an adult education substitute. In addition, staff development documentation
must be completed and submitted to the Adult Personnel Unit by June 15. Refer to the Staff Development Plan dated May 9, 2002.
5. The parties
will agree to the Staff Development Plan (attached) by means of a side letter.
6. The parties
shall add a modification to the Agreement for the Five Year Rule at the Central
Office of the Division of Adult and Career Education (DACE) to read as follows:
Adult and Career Education (DACE) exception ‑‑after an employee in
a nonschool non‑classroom position has served a full five year term, the
position will be announced and the incumbent may reapply. A panel composed of 50% District and 50% UTLA
members will conduct a selection process and list the three (3) top candidates
in unranked order. The DACE
Superintendent will select from the top three (3) candidates on the applicable
lists. (Article XXXI, Section 13.0 b)
7. The parties
shall amend the "Ten (10) Consecutive Years" clause in Appendix E,
5.0 with the following language: *Applicable to all employees with 10
consecutive years or more c DACE service as described in Article XXI, Section
4.7b (1) and who are eligible for step advancement ($.50 above Step 3 Rate). One year of longevity will be granted to
candidates who complete the designated two consecutive year step advancement
option.
8. The parties
have agreed to implement a Half‑Time Leave for inclusion in Article XXI,
Section 10.3 to read as follows:
A Half‑Time
Leave shall be granted on a year‑to‑year basis to allow a permanent
teacher in the Division of Adult and Career Education (DACE) to continue
service for one‑half of his/her tenured assignment hours.
A leave
for other than one‑half time may be granted on a year‑by‑year
basis subject to school schedules, availability of classes, and approval by the
principal and the Division of Adult and Career Education (DACE).
An
application must be on file in the DACE Personnel Office by April 15 for the
fall term and November 15 for the winter or spring terms.
Eligibility
for health and welfare benefits for employees who work less than half‑time
will be determined pursuant to Article XVI, Section 3.0.
We agree that current
teachers assigned 18 hours per week or more who were paid for 734 hour: in
school year 2001‑2002 will be eligible for their step increase
retroactive to July 1, 2002.
We also agree that teachers
assigned less than 18 hours per week in school year 2001‑2002 may use
these accrued hours in combination with hours accrued for school year 2002‑03
for possible step advance effective July 1, 2003. Final
determination is based on the teacher having been paid for 734 hours and
completion/submission of the required professional development activities.
